Welcome to the websites and mobile app (the “Site”) of Malecare, Inc. (“Malecare,” “we,” “our,” or “us”). It is important to us that when you use this Site, you are fully aware of your respective legal rights and obligations. For that reason, we have created these Terms of Service (“Terms”) as the legally binding terms to govern your use of the Site. Please read these Terms carefully before using the Site, because these terms affect your legal rights and obligations.
Cancermatch does not and will not review any photographs or any information you enter into journal entries using Cancermatch. Always seek the advice of a doctor or other qualified healthcare provider whenever you have a personal question about cancer symptoms, cancer or other medical conditions. DO NOT disregard the advice of a doctor or other qualified healthcare provider, or delay seeking medical advice or treatment, because of information provided to you on Cancermatch. If you engage in any clinical trial program you learn about through Cancermatch, you agree that you do so at your own risk and are voluntarily participating in such clinical trial programs. Such clinical trial programs are not affiliated with or endorsed by Malecare. CANCERMATCH IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL DIAGNOSIS OR TREATMENT; AND RELIANCE ON ANY INFORMATION PROVIDED BY CANCERMATCH OR ANYONE WHO SHARES INFORMATION ON CANCERMATCH IS SOLELY AT YOUR OWN RISK. ALL INFORMATION PROVIDED ON CANCERMATCH OR IN CONNECTION WITH ANY COMMUNICATIONS SUPPORTED BY CANCERMATCH, IS INTENDED TO BE FOR GENERAL INFORMATIONAL PURPOSES ONLY, AND IS IN NO WAY INTENDED TO CREATE A PHYSICIAN-PATIENT RELATIONSHIP AS DEFINED BY STATE AND FEDERAL LAW. IF APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF SOME OR ALL OF THE ABOVE IMPLIED WARRANTIES TO APPLY TO YOU, THE ABOVE EXCLUSIONS WILL APPLY TO YOU ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.
IF YOU ACCESS THE SITE FROM THE UK OR EEA, NOTHING IN THIS AGREEMENT SHALL EXCLUDE OR LIMIT LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM THE NEGLIGENCE OF EITHER PARTY OR THEIR SERVANTS, AGENTS OR EMPLOYEES.

Any authorization to copy Material granted by Malecare in any part of this Site for any reason is restricted to making a single copy for non-commercial, personal, entertainment use, and is subject to your keeping intact all copyright and other proprietary notices. Also, decompiling, reverse engineering, disassembling, or otherwise reducing the code used in any software on this Site into a readable form in order to examine the construction of such software and/or to copy or create other products based (in whole or in part) on such software, is prohibited.

Malecare cannot ensure that you will be satisfied with any products or services that you purchase from any third-party site that links to or from Malecare. Malecare does not endorse any of the products or services, nor has Malecare taken any steps to confirm the accuracy or reliability of any of the information contained on such third-party sites. Malecare does not make any representations or warranties as to the security of any information (including, without limitation, credit card and other personal information) you might be requested to give any third party, and you irrevocably waive any claim against us with respect to such sites. We strongly encourage you to make whatever investigation you feel necessary or appropriate before proceeding with any online transaction with any of these third parties.

Welcome! To help inform you, we provide this notice explaining our online information practices and the choices you can make about the collection and use of information you submit or we collect through our websites www.malecare.org , www.cancergraph.com , www.cancermatch.com and our related mobile applications, Cancergraph, CancerMatch and our other services, (collectively, the “Site”). The Site is owned and operated by the nonprofit corporation Malecare, Inc. (“Malecare,” “we,” “our,” or “us”).
When you use the Site, you are contracting with Malecare, which is located at 63 Avenue A, New York, NY 10009. If you reside outside of the United States, Malecare is your data controller. By using the Site, US and EEA residents expressly consent to our collection, use, disclosure, transfer and retention of your personal information as described in this Privacy Notice.
You can browse the Site without telling us who you are or revealing any personal information about yourself.
Our goal is to collect and use only that information that we think is required to support our services and for legitimate medical research purposes.

You may opt out of receiving email notifications from Malecare by following the unsubscribe instructions within the emails. Similarly, in Cancermatch, you may opt in/out of geo-location tracking and push notifications by changing your app’s settings. You may also delete your Cancermatch account by following the instructions in the app or by emailing us at privacy@malecare.org . Note that deleting your account will not delete anonymized, aggregated data that we have collected for research purposes.
When you visit our website, you may encounter tracking technologies/cookies from us or third-party service providers, such as Google Analytics, to assist us with various aspects of our Site operations and services, including to analyze the audience of the website and improve the website’s content. Registered members of Cancermatch can review and change their personal information and personal health information at any time by accessing their accounts on the app. To obtain the personal health information maintained in your account, you can also send yourself a report (which you can then print, e.g., from your browser). You should promptly update your personal information if it changes or becomes inaccurate. We may retain some information from closed accounts so that we can support research with your anonymized information, comply with law, prevent fraud, assist with investigations, resolve disputes, analyze, or troubleshoot programs, enforce our Terms of Use, or take other actions permitted by law. Likewise, if your account is terminated or suspended, we may maintain some information to prevent re-registration.
You may also request to exercise those rights by contacting us as set out in Section 14 of this Privacy Notice below.
Please note that you also have the right under applicable data protection law to lodge a complaint about our processing of your personal information with a data protection supervisory authority.
Our website may contain links to other third-party websites. We are not responsible for the privacy practices or the content of these third-party sites.
We store and process your information on our servers located in the United States. We have implemented measures designed to secure your personal information from accidental loss, misuse, unauthorized access, disclosure, or alteration.
